WHITEFISH- Flathead County Attorneys are waiting for the federal government to prosecute a man for his alleged role in an armed home invasion and robbery near Whitefish.

Kevin Gaethle is being investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Last July, Gaethle and 3 other men allegedly stole several high-powered fire arms from a Happy Valley home and held a 16 year old girl at gun point.

Monday, the Flathead County Deputy Attorney filed a motion to put a hold on the state case, so a federal investigation and prosecution can proceed.

If the federal government drops the case, the county attorney's office hopes to resume the prosecution in Flathead District Court.

A judge will determine if county attorneys are forever barred from the case.
